March seemed to be an incredibly busy month for commercial property related deals, which is great news against the prevailing economic problems, but to put this into perspective, a number of the deals in which we have been involved with recently are re-finance transactions.
A growing number of deals have been facilitated by the use of Search Indemnity Insurance. This is a great product to get deals over the line where the lender is in agreement to use such cover, given the patchy response times for the receipt of search results.
Care must be taken to ensure that the most appropriate product is used – i.e. No Search Indemnity, Search Validation or Search Delay insurance and again the extent of the searches which are covered needs to be checked – does the policy include chancel, mining, highways or environmental searches?
